The new EMC Directive 2004 / 108 / EC has replaced the prior EMC Directive 89 / 336 / EC following the end of the two year transition period. Annex II of [4] states that : the maker shall perform an electro-magnetic compatibility assessment of the equipment, on the grounds of the important phenomena, with a view to meeting the protection necessities set down in Annex I, point one. Where the equipment is really capable of taking different configurations, the electric compatibility assessment shall confirm whether the equipment meets the protection necessities set down in Annex I, point one, in all of the possible configurations identified by the maker as representative of its intended use.
